Falta espai per a emmagatzemar?:&nbsp;<a href=\"http:\/\/housfy.com\/blog\/alquiler-de-trasteros\/\" target=\"_blank\" rel=\"noreferrer noopener\">Descobreix els trasters virtuals<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Llei de Propietat Horitzontal: Lloguer de trasters<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La Llei de Propietat Horitzontal es refereix als trasters a l&#8217;article 2.2. Aquest diu: <em>\u201cLes normes reguladores de l&#8217;arrendament d&#8217;habitatge s&#8217;aplicaran tamb\u00e9 (\u2026) [a] als trasters (\u2026)\u201d.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En el seu arrendament has de diferenciar 2 sup\u00f2sits:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Quan el traster no \u00e9s jur\u00eddicament independent de l&#8217;habitatge.<\/strong>&nbsp;\u00c9s un \u201cannex\u201d. Aleshores, es llogaria sota la regulaci\u00f3 de \u201clloguer d&#8217;habitatge\u201d i \u201cno d&#8217;\u00fas diferent\u201d [al de domicili].<\/li>\n\n\n\n<li><strong>Quan el traster s\u00ed que \u00e9s independent de la casa.<\/strong>&nbsp;Ser \u201cindependent\u201d implica parlar d&#8217;una altra edificaci\u00f3. Aleshores es lloga&nbsp;sota la regulaci\u00f3 d&#8217;\u201c\u00fas diferent\u201d.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">El traster tamb\u00e9 ha de satisfer les exig\u00e8ncies de seguretat del Codi T\u00e8cnic de l&#8217;Edificaci\u00f3. Aquest document es defineix a l&#8217;article 3.2 de la Llei 38\/1999, com <em>\u201cel marc normatiu que estableix les exig\u00e8ncies b\u00e0siques de qualitat dels edificis de nova construcci\u00f3 i de les seves instal\u00b7lacions, aix\u00ed com de les intervencions que es realitzin en els edificis existents\u201d.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Escrivim des de Barcelona. Per tant, estudiarem el Codi Civil de Catalunya, que \u00e9s diferent de la Llei de Propietat Horitzontal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Es pot prohibir el lloguer de trasters en una comunitat?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">S\u00ed, quan els<strong>&nbsp;Estatuts de la comunitat incloguin aquest veto de forma clara<\/strong>. El legislador no deixa lloc a dubtes a l&#8217;article 11 ep\u00edgraf b del Codi Civil Catal\u00e0, segons el qual els Estatuts poden contenir regles sobre <em>\u201cles limitacions d&#8217;\u00fas i la resta de c\u00e0rregues dels elements privatius\u201d.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Es pot llogar un traster a un ve\u00ed?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">S\u00ed que li pots llogar el traster perqu\u00e8 es tracta d&#8217;alg\u00fa que ja resideix a la comunitat i, per tant, t\u00e9 acc\u00e9s a les zones comunes de l&#8217;edifici.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Abans d&#8217;arrendar el traster has de tenir en compte 2 coses:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>On tributa el lloguer de trasters en comunitats de propietaris:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>A l&#8217;IVA amb un 21% (model 303)<\/strong>.<\/li>\n\n\n\n<li><strong>A l&#8217;IRPF com a rendiment del capital immobiliari percebut pel propietari<\/strong>. Es tracta, doncs, del mateix cas que el&nbsp;lloguer d&#8217;habitacions.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Sempre has de revisar que l&#8217;escriptura del traster no impedeixi el lloguer<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Lloguer de traster a un ve\u00ed segons el Codi Civil de Catalunya<\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Configuraci\u00f3 Jur\u00eddica del Traster<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Es pot llogar?<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Explicaci\u00f3 detallada per al ciutad\u00e0<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Articles clau del CCCat<\/strong><\/td><\/tr><\/thead><tbody><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Finca Privativa Independent<\/strong>&nbsp;Posseeix:&nbsp;* Escriptura pr\u00f2pia.&nbsp;* N\u00famero de registre de la propietat.&nbsp;* Quota de participaci\u00f3 independent.<\/td><td class=\"has-text-align-left\" data-align=\"left\">S\u00ed<\/td><td class=\"has-text-align-left\" data-align=\"left\">Tens la propietat absoluta de l&#8217;espai. Pots llogar-lo a qualsevol ve\u00ed sense demanar perm\u00eds a ning\u00fa. La comunitat no pot prohibir-t&#8217;ho, tret que en els Estatuts oficials de l&#8217;edifici (inscrits en el Registre de la Propietat) hi hagi una norma que prohibeixi expressament el lloguer de trasters.<\/td><td class=\"has-text-align-left\" data-align=\"left\">Article 553-36:&nbsp;\u201c\u00das i gaudi dels elements privatius\u201d&nbsp;Ep\u00edgraf 1.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Annex Inseparable<\/strong>&nbsp;Manca de:&nbsp;* Escriptura pr\u00f2pia (est\u00e0 vinculat al pis principal).<\/td><td class=\"has-text-align-left\" data-align=\"left\">S\u00ed<\/td><td class=\"has-text-align-left\" data-align=\"left\">La llei prohibeix que venguis o hipotequis el traster per separat del pis. No obstant aix\u00f2, et permet llogar el seu \u00fas temporalment.<\/td><td class=\"has-text-align-left\" data-align=\"left\">Article 553-35&nbsp;\u201cAnnexos\u201d<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Element Com\u00fa d&#8217;\u00das Exclusiu<\/strong>&nbsp;El traster f\u00edsicament pertany a tota la comunitat.&nbsp;No obstant aix\u00f2, per contracte se t&#8217;assigna, com a propietari del teu pis, dret a usar i llogar el traster en exclusiva.<\/td><td class=\"has-text-align-left\" data-align=\"left\">No, tret que les normes de l&#8217;edifici autoritzin l&#8217;arrendament.<\/td><td class=\"has-text-align-left\" data-align=\"left\">L&#8217;\u00fas del traster est\u00e0 blindat i unit a l&#8217;\u00fas del teu habitatge. Si tu vius al pis, no pots \u00abdesmembrar-lo\u00bb per llogar el traster a un ve\u00ed.&nbsp;L&#8217;\u00fanica excepci\u00f3: Que el Reglament de R\u00e8gim Interior o els Estatuts del teu edificio permetin expressament que els ve\u00efns es lloguin o s&#8217;intercanvi\u00efn aquests trasters comuns entre si. Si les normes del teu edifici ho autoritzen, es pot; si no diuen res, la llei ho prohibeix.<\/td><td class=\"has-text-align-left\" data-align=\"left\">Article 553-52.2.b:&nbsp;\u201cComunitats i subcomunitats per a garatges i trasters\u201d<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Puc llogar el meu traster a una persona aliena a la comunitat?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">S\u00ed que \u00e9s possible arrendar el traster a una persona aliena sempre que:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Els estatuts de l&#8217;edifici no ho prohibeixin expressament.<\/li>\n\n\n\n<li>Estigui registrat com una finca privativa independent.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Lloguer de traster a una persona aliena a la comunitat:<\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Configuraci\u00f3 Jur\u00eddica del Traster<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Es pot llogar a un estrany?<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Fonament Legal i Explicaci\u00f3 (CCCat)<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Articles clau del CCCat<\/strong><\/td><\/tr><\/thead><tbody><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Finca Privativa Independent<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">S\u00ed<\/td><td class=\"has-text-align-left\" data-align=\"left\">Tret que els Estatuts disposin el contrari.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-36<\/strong>&nbsp;<strong>\u201c\u00das i gaudi dels elements privatius<\/strong>\u201d<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Annex Inseparable<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">No<\/td><td class=\"has-text-align-left\" data-align=\"left\">Els annexos estan lligats indissolublement al dest\u00ed de l&#8217;habitatge.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-35<\/strong>&nbsp;\u201c<strong>Annexos<\/strong>\u201d<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Element Com\u00fa d&#8217;\u00das Exclusiu<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Mai<\/td><td class=\"has-text-align-left\" data-align=\"left\">Al tractar-se d&#8217;un espai la titularitat del qual \u00e9s de tot l&#8217;edifici, el dret d&#8217;\u00fas exclusiu mai es pot separar.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-52 \u201cComunitats i subcomunitats per a garatges i trasters\u201d ep\u00edgraf 2 lletra b<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Segons el Codi Civil Catal\u00e0: Quins s\u00f3n els problemes per llogar un traster a externs?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">En primer lloc, una&nbsp;<strong>eventual nul\u00b7litat del contracte de lloguer<\/strong>. En segon lloc, que<strong>&nbsp;la comunitat de propietaris prohibeixi judicialment l&#8217;acc\u00e9s al llogater extern<\/strong>, basant-se en la infracci\u00f3n dels estatuts i en motius de seguretat.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Problema<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Descripci\u00f3 del Risc i Efectes Reals<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Base Legal Codi Civil Catal\u00e0<\/strong><\/td><\/tr><\/thead><tbody><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>\u00das indegut d&#8217;un traster<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">L&#8217;\u00fanica finalitat d&#8217;un traster \u00e9s emmagatzemar objectes. Si un propietari, per exemple, el sotsarrenda com a habitatge, la resta de la comunitat podr\u00e0 requerir la cessaci\u00f3 d&#8217;aquesta activitat.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-40.2 CCCat \u201cProhibicions i restriccions d&#8217;\u00fas dels elements privatius i comuns<\/strong>\u201d.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Infracci\u00f3 Estatut\u00e0ria<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Quan els Estatuts de la comunitat prohibeixin expressament l&#8217;acc\u00e9s o lloguer a persones alienes a la finca. La comunitat pot emprendre accions legals contra tu.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-40.2 CCCat \u201cProhibicions i restriccions d&#8217;\u00fas dels elements privatius i comuns\u201d.<\/strong><\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Riscos en deixar entrar un estrany a l&#8217;edifici<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Els ve\u00efns poden oposar-se legalment al\u00b7legant que es posa en risc la seva seguretat.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-40.2 CCCat \u201cProhibicions i restriccions d&#8217;\u00fas dels elements privatius i comuns\u201d.<\/strong><\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Nul\u00b7litat del Contracte<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Si el teu traster est\u00e0 inscrit a les escriptures com un \u00abannex\u00bb del teu pis, no t\u00e9 entitat jur\u00eddica pr\u00f2pia. Llogar-lo a un estrany de forma independent \u00e9s il\u00b7legal.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-40.2 CCCat \u201cProhibicions i restriccions d&#8217;\u00fas dels elements privatius i comuns\u201d.<\/strong><\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Desnonament per la Comunitat<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Si el traster \u00e9s un element com\u00fa de l&#8217;edifici, per\u00f2 d&#8217;\u00fas exclusiu del teu pis, la seva desvinculaci\u00f3 per lucrar-te amb un tercer extern est\u00e0 totalment prohibida.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-52 \u201cComunitats i subcomunitats per a garatges i trasters\u201d ep\u00edgraf 2 lletra b<\/strong>.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Responsabilitat per danys causats pel llogater extern<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Quan causi destrosses a les zones comunes, com a propietari respons solid\u00e0riament davant la comunitat.<\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Article 553-40.2 CCCat \u201cProhibicions i restriccions d&#8217;\u00fas dels elements privatius i comuns\u201d.<\/strong><\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Eventual insufici\u00e8ncia de la cobertura de l&#8217;asseguran\u00e7a de llar quan un tercer \u00e9s el perjudicat<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Quan el contingut pertany a un tercer ali\u00e8 a la comunitat i hi ha robatoris o incendis pot passar que l&#8217;asseguran\u00e7a no ho cobreixi.&nbsp;<a href=\"https:\/\/housfy.com\/seguros\" rel=\"noreferrer noopener\" target=\"_blank\">Contracta una asseguran\u00e7a completa amb Grup&nbsp;Housfy<\/a><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>El CCCat no for\u00e7a a tenir asseguran\u00e7a. Ara b\u00e9, els Estatuts de la Comunitat poden obligar-t&#8217;hi<\/strong>.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Consulta el text \u00edntegre dels articles citats en les 3 taules anteriors:<\/em><\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Articles del Codi Civil Catal\u00e0 sobre lloguer de trasters<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">&nbsp;<\/td><\/tr><\/thead><tbody><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>553-35 Annexos<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">\u201cEs determinen en el t\u00edtol de constituci\u00f3 com a espais f\u00edsics o drets vinculats de manera inseparable a un element privatiu, no tenen quota especial i s\u00f3n de titularitat privativa a tots els efectes\u201d.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>553-36.1 \u00das i gaudi dels elements privatius<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">\u201cEls propietaris d&#8217;elements privatius poden exercir totes les facultats del dret de propietat sense cap altra restricci\u00f3 que les que deriven del r\u00e8gim de propietat horitzontal\u201d.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>553-40.2 Prohibicions i restriccions d&#8217;\u00fas dels elements privatius i comuns<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">\u201cLa presid\u00e8ncia de la comunitat (\u2026) per iniciativa pr\u00f2pia o a petici\u00f3 d&#8217;una quarta part dels propietaris, ha de requerir fefaentment a qui les faci que deixi de fer-les. Si la persona requerida persisteix en la seva activitat, la junta de propietaris pot exercir contra els propietaris i els ocupants de l&#8217;element privatiu l&#8217;acci\u00f3 per fer-la cessar, que s&#8217;ha de tramitar d&#8217;acord amb les normes processals corresponents. Una vegada presentada la demanda, (\u2026) l&#8217;autoritat judicial ha d&#8217;adoptar les mesures cautelars que consideri convenients\u201d.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>553-52.2 Comunitats i subcomunitats per a garatges i trasters<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">\u201cNo existeix subcomunidad per al local de garatge o trasters en els casos seg\u00fcents:&nbsp;(\u2026)&nbsp;B. Si el local destinat a garatge o trasters es configura com a element com\u00fa del r\u00e8gim de propietat horitzontal.
