{"id":349408,"date":"2026-04-17T11:09:09","date_gmt":"2026-04-17T09:09:09","guid":{"rendered":"https:\/\/www.fincasolivares.com\/?p=349408"},"modified":"2026-04-17T12:10:51","modified_gmt":"2026-04-17T10:10:51","slug":"modificacions-al-pis-de-lloguer-que-han-de-saber-arrendatari-i-arrendador","status":"publish","type":"post","link":"https:\/\/www.fincasolivares.com\/ca\/modificacions-al-pis-de-lloguer-que-han-de-saber-arrendatari-i-arrendador\/","title":{"rendered":"Modificacions al pis de lloguer: Qu\u00e8 han de saber arrendatari i arrendador?"},"content":{"rendered":"\n<h1 class=\"wp-block-heading\">La clau de l&#8217;\u00e8xit en el lloguer: la comunicaci\u00f3 flu\u00efda i sincera<\/h1>\n\n\n\n<p>Perqu\u00e8 la relaci\u00f3 en un lloguer funcioni correctament, \u00e9s imprescindible que hi hagi una comunicaci\u00f3 constant, clara i sincera entre ambdues parts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tres aspectes a tenir en compte quan ets llogater<\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Concepte<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\"><strong>Descripci\u00f3<\/strong><\/td><\/tr><\/thead><tbody><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Titularitat<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Encara que l&#8217;habitatge estigui llogat, la propietat continua sent de l&#8217;arrendador.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Contracte<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Revisa si existeix alguna cl\u00e0usula espec\u00edfica que prohibeixi fer canvis al pis.<\/td><\/tr><tr><td class=\"has-text-align-left\" data-align=\"left\"><strong>Transpar\u00e8ncia<\/strong><\/td><td class=\"has-text-align-left\" data-align=\"left\">Mai ocultis la teva intenci\u00f3 de fer modificacions a l&#8217;immoble llogat.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Per augmentar les possibilitats que el propietari accepti modificacions a l&#8217;habitatge, et recomanem:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Actuar sempre de bona fe.<\/strong><\/li>\n\n\n\n<li><strong>Complir amb\u00a0tots els teus deures<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>En canvi,&nbsp;<strong>mai<\/strong>&nbsp;duguis a terme activitats &#8220;molestes, insalubres, nocives, perilloses o il\u00b7l\u00edcites&#8221; a l&#8217;immoble, ni cap de les altres accions&nbsp;<a href=\"https:\/\/www.conceptosjuridicos.com\/lau-articulo-27\/\" rel=\"noreferrer noopener\" target=\"_blank\">vetades a l&#8217;article 27.2<\/a>&nbsp;de la Llei d&#8217;Arrendaments Urbans.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Serem llogaters i tenim problemes de mobilitat: Ens empara la llei?<\/h1>\n\n\n\n<p>Si tu o el teu c\u00f2njuge teniu dificultats de mobilitat, no us heu d&#8217;amo\u00efnar: l&#8217;<strong>article 24 de la LAU<\/strong>&nbsp;us protegeix. Els seu beneficiaris s\u00f3n:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ciutadans amb dificultats de mobilitat (de qualsevol edat)<\/strong>.<\/li>\n\n\n\n<li>Persones que\u00a0<strong>superin els setanta anys<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Per exercir aquest dret, s&#8217;han de complir els requisits seg\u00fcents:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Notificar per escrit<\/strong>\u00a0a l&#8217;arrendador la voluntat d&#8217;executar l&#8217;adaptaci\u00f3.<\/li>\n\n\n\n<li><strong>Finalitat de l&#8217;obra:<\/strong>\u00a0L&#8217;actuaci\u00f3 s&#8217;ha de fer per garantir l&#8217;accessibilitat del llogater, del seu c\u00f2njuge (amb independ\u00e8ncia de l&#8217;orientaci\u00f3 sexual) o d&#8217;un familiar que hi convisqui de forma permanent.<\/li>\n<\/ol>\n\n\n\n<p><strong>Limitacions legals a tenir en compte:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;adaptaci\u00f3 no pot afectar l&#8217;<strong>estabilitat ni la seguretat<\/strong>\u00a0de l&#8217;habitatge.<\/li>\n\n\n\n<li>No es poden transformar els\u00a0<strong>espais comuns<\/strong>\u00a0de l&#8217;edifici.<\/li>\n\n\n\n<li>En finalitzar el contracte, si el propietari ho exigeix, el llogater estar\u00e0 obligat a\u00a0<strong>reposar l&#8217;habitatge a l&#8217;estat anterior<\/strong>. Per aquest motiu, \u00e9s recomanable utilitzar ajudes t\u00e8cniques f\u00e0cils de retirar.<\/li>\n<\/ul>\n\n\n\n<h1 class=\"wp-block-heading\">S\u00f3c llogater: Puc comen\u00e7ar a fer modificacions pel meu compte?<\/h1>\n\n\n\n<p>La resposta dependr\u00e0 principalment de dos factors:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>L&#8217;actitud del propietari<\/strong>\u00a0durant la\u00a0negociaci\u00f3 del contracte d&#8217;arrendament.<\/li>\n\n\n\n<li><strong>L&#8217;envergadura de la modificaci\u00f3<\/strong>\u00a0considera abordar nom\u00e9s\u00a0&#8220;obres menors&#8221;. Atenci\u00f3 \u00e9s molt important, que\u00a0en fer-les:\u00a0<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>T&#8217;acompanyi\u00a0un expert.<\/li>\n\n\n\n<li>Siguis prudent.<\/li>\n<\/ul>\n\n\n\n<p>La resposta ser\u00e0&nbsp;<strong>negativa<\/strong>&nbsp;si:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Al contracte consta una cl\u00e0usula que impedeix expl\u00edcitament realitzar qualsevol canvi.<\/li>\n\n\n\n<li>Si parlem d&#8217;una &#8220;obra major&#8221;.<\/li>\n<\/ul>\n\n\n\n<p>Per contra, ser\u00e0&nbsp;<strong>afirmativa<\/strong>&nbsp;quan:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El llogater disposi del\u00a0<strong>perm\u00eds escrit<\/strong>\u00a0del propietari.<\/li>\n\n\n\n<li>L&#8217;obra\u00a0<strong>no<\/strong>\u00a0<strong>comprometi<\/strong>\u00a0<strong>la<\/strong>\u00a0<strong>seguretat<\/strong>\u00a0<strong>ni<\/strong>\u00a0<strong>l&#8217;estabilitat<\/strong>\u00a0de l&#8217;habitatge o de l&#8217;edifici.<\/li>\n<\/ul>\n\n\n\n<p>L&#8217;<strong>article 23.1 de la LAU<\/strong>&nbsp;\u00e9s el que regula aquest sup\u00f2sit:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>&#8220;L\u2019arrendatari no podr\u00e0 realitzar sense el consentiment de l&#8217;arrendador, expressat per escrit, obres que modifiquin la configuraci\u00f3 de l&#8217;habitatge o dels accessoris (mobiliari, trasters, places de garatge i altres depend\u00e8ncies). En cap cas es podran realitzar obres que provoquin una disminuci\u00f3 en l&#8217;estabilitat o seguretat de l&#8217;habitatge&#8221;.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Aix\u00ed mateix, l&#8217;article 23.2 protegeix el propietari: si el llogater fa obres unilaterals que afectin la seguretat, l&#8217;arrendador podria exigir la&nbsp;<strong>reposici\u00f3 immediata<\/strong>&nbsp;de l&#8217;immoble a l&#8217;estat anterior.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Obres de conservaci\u00f3: Obligaci\u00f3 del propietari<\/h1>\n\n\n\n<p>Segons l&#8217;<strong>article 21.1 de la LAU<\/strong>, l&#8217;arrendador t\u00e9 l&#8217;obligaci\u00f3 d&#8217;executar,&nbsp;<strong>sense dret a apujar la renda<\/strong>, totes les reparacions necess\u00e0ries per conservar l&#8217;habitatge en&nbsp;<strong>condicions d&#8217;habitabilitat<\/strong>. Recorda que, a gaireb\u00e9 totes les comunitats aut\u00f2nomes \u2014excepte Extremadura i Madrid\u2014, \u00e9s obligatori tenir vigent la&nbsp;<strong>c\u00e8dula d&#8217;habitabilitat<\/strong>&nbsp;per poder llogar.<\/p>\n\n\n\n<p>L&#8217;article 21.2 equilibra els drets de les dues parts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si una obra de conservaci\u00f3 no es pot postposar fins a la fi del contracte, el llogater est\u00e0\u00a0<strong>obligat a suportar-la<\/strong>, encara que sigui molesta.<\/li>\n\n\n\n<li>Si l&#8217;obra dura\u00a0<strong>m\u00e9s de vint dies<\/strong>, la renda s&#8217;haur\u00e0 de reduir proporcionalment a la part de l&#8217;habitatge de la qual el llogater no pugui gaudir.<\/li>\n<\/ul>\n\n\n\n<h1 class=\"wp-block-heading\">Treballs de millora: Una elecci\u00f3 que l&#8217;arrendador ha d&#8217;analitzar amb calma&nbsp;<\/h1>\n\n\n\n<p>L&#8217;<strong>article 22.2 de la LAU<\/strong>&nbsp;permet al propietari realitzar millores notificant-ho per escrit amb un m\u00ednim de&nbsp;<strong>tres mesos d&#8217;antelaci\u00f3<\/strong>, detallant-ne la naturalesa, la durada i el cost. El llogater, durant el<strong>&nbsp;mes seg\u00fcent a la notificaci\u00f3, t\u00e9 dret a desistir del contracte<\/strong>&nbsp;si no est\u00e0 d&#8217;acord amb les obres.<\/p>\n\n\n\n<p>At\u00e8s que aquestes millores s\u00f3n una elecci\u00f3 i poden comportar la p\u00e8rdua del llogater, des de&nbsp;<strong>Grup Housfy<\/strong>&nbsp;recomanem posposar les modificacions importants fins que l&#8217;immoble estigui buit.<\/p>\n\n\n\n<p>D&#8217;acord amb la jurisprud\u00e8ncia del Tribunal Constitucional, la Llei d&#8217;Arrendaments Urbans (LAU) t\u00e9 prefer\u00e8ncia jer\u00e0rquica sobre el Codi Civil Catal\u00e0 en els aspectes estudiats en aquest text.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La clau de l&#8217;\u00e8xit en el lloguer: la comunicaci\u00f3 flu\u00efda i sincera Perqu\u00e8 la relaci\u00f3 en un lloguer funcioni correctament, \u00e9s imprescindible que hi hagi una comunicaci\u00f3 constant, clara i sincera entre ambdues parts.
