Qu\u00e8 retribueix l&#8217;arrendatari a l&#8217;arrendador mitjan\u00e7ant l&#8217;arrendament?<\/h3>\n\n\n\n<p>L&#8217;inquil\u00ed paga al propietari per la&nbsp;<strong>cessi\u00f3 del dret d&#8217;\u00fas i gaudi<\/strong>&nbsp;de l&#8217;immoble. Aquesta situaci\u00f3 es mantindr\u00e0&nbsp;<strong>mentre estigui vigent el contracte d&#8217;arrendament<\/strong>. A m\u00e9s, l&#8217;abonament d&#8217;aquesta quantitat busca garantir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;adequat manteniment de l&#8217;immoble.<\/li>\n\n\n\n<li>El manteniment del vincle jur\u00eddic entre les\u00a0parts a partir de la signatura del contracte.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2. Quines s\u00f3n les caracter\u00edstiques del pacte entre propietari i inquil\u00ed?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>M\u00e8tode de formalitzaci\u00f3:<\/strong>\u00a0Grup Housfy recomana rubricar un\u00a0<strong>contracte escrit<\/strong>. La ra\u00f3 \u00e9s que la seva redacci\u00f3 permet que pugui ser consultat per ambdues parts i minimitza els conflictes. Per contra, el mer acord verbal \u2014tot i que \u00e9s legal\u2014 condueix a la inseguretat jur\u00eddica i no evita\u00a0l&#8217;enfrontament.<\/li>\n\n\n\n<li><strong>Termini legal de lloguer:<\/strong>\u00a0Dep\u00e8n del tipus d&#8217;inquil\u00ed que signi l&#8217;arrendament:\n<ul class=\"wp-block-list\">\n<li>Quan s\u00f3n\u00a0<strong>persones f\u00edsiques<\/strong>, el termini m\u00ednim \u00e9s de cinc (5) anys.<\/li>\n\n\n\n<li>Quan es tracta de\u00a0<strong>persones jur\u00eddiques\u00a0(empreses)<\/strong>, el m\u00ednim puja als set (7) anys.<\/li>\n\n\n\n<li>D&#8217;acord amb la Llei d&#8217;Arrendaments Urbans (LAU), sempre que hi hagi acord entre inquil\u00ed i propietari, ambd\u00f3s terminis s\u00f3n prorrogables.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Amb tot, la vig\u00e8ncia del pacte pot acabar a inst\u00e0ncies de cada part invocant els seg\u00fcents drets:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>L&#8217;inquil\u00ed pot invocar el dret de desistiment:<\/strong>\u00a0Per a la seva aplicaci\u00f3, el legislador estableix tres condicions:\n<ol class=\"wp-block-list\">\n<li>Cal fer-ho una vegada transcorreguts<strong>\u00a0almenys sis (6) mesos<\/strong>.<\/li>\n\n\n\n<li>S&#8217;ha de\u00a0<strong>comunicar fefaentment<\/strong>\u00a0a l&#8217;arrendador.<\/li>\n\n\n\n<li>Aquesta comunicaci\u00f3 s&#8217;ha de produir amb una\u00a0<strong>antelaci\u00f3 m\u00ednima de trenta (30) dies<\/strong>.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>El propietari pot recuperar l&#8217;immoble:<\/strong>\u00a0El legislador especifica: &#8220;Un cop\u00a0<strong>transcorregut el primer any de durada<\/strong>\u00a0del contracte i sempre que l&#8217;arrendador\u00a0<strong>sigui persona f\u00edsica<\/strong>, no procedir\u00e0 la pr\u00f2rroga obligat\u00f2ria del contracte quan, al temps de la seva celebraci\u00f3, s&#8217;hagu\u00e9s fet constar en aquest,\u00a0<strong>de forma expressa, la necessitat per a l&#8217;arrendador d&#8217;ocupar l&#8217;habitatge arrendat<\/strong>\u00a0abans del transcurs de cinc anys (&#8230;)&#8221;.<\/li>\n\n\n\n<li><strong>Periodicitat i termini de pagament:<\/strong>\u00a0El pagament \u00e9s\u00a0<strong>mensual\u00a0<\/strong>i s&#8217;ha d&#8217;efectuar, per llei,\u00a0<strong>dins dels set primers dies del mes<\/strong>.<\/li>\n\n\n\n<li><strong>Drets i deures:<\/strong>\u00a0Des del moment de la signatura, ambdues parts queden\u00a0subjectes a drets i obligacions.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Com assegurem la teva renda de lloguer?<\/h2>\n\n\n\n<p>Coneix&nbsp;les dues mesures que permeten a Grup Housfy descartar indicadors d&#8217;impagament abans de presentar-te candidats:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>An\u00e0lisi exhaustiva de dades:<\/strong>\u00a0Estudiem factors com l&#8217;estabilitat laboral o, en cas de jubilats, la\u00a0quantia de la pensi\u00f3. Com m\u00e9s estabilitat o ingressos,\u00a0<strong>m\u00e9s augmenten les possibilitats de ser seleccionat<\/strong>. Elaborem r\u00e0tios d&#8217;endeutament precises per a cada aspirant.<\/li>\n\n\n\n<li><strong>Gesti\u00f3 integral digitalitzada:<\/strong>\u00a0La tecnologia ens ajuda a anticipar eventuals problemes.<\/li>\n<\/ol>\n\n\n\n<p>Assegurem la teva renda gr\u00e0cies a tres elements addicionals:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>La signatura del\u00a0<strong>contracte de renda garantida<\/strong>.<\/li>\n\n\n\n<li>L&#8217;aplicaci\u00f3 del sistema de\u00a0<strong>&#8216;scoring&#8217;<\/strong>\u00a0a cada candidat.<\/li>\n\n\n\n<li>La inclusi\u00f3 de la cl\u00e0usula de\u00a0<strong>&#8220;cessi\u00f3 de drets processals&#8221;<\/strong>\u00a0en el contracte de lloguer.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Signatura del contracte de renda garantida<\/h2>\n\n\n\n<p>El &#8220;contracte de renda garantida&#8221; assegura al propietari el cobrament del lloguer. \u00c9s important aclarir que aquest document assegura la renda durant&nbsp;<strong>dotze (12) mensualitats<\/strong>. El primer mes s&#8217;abona recorrent a&nbsp;l&#8217;import de la fian\u00e7a&nbsp;i els dos seg\u00fcents van a c\u00e0rrec de Grup Housfy.<\/p>\n\n\n\n<p><strong>Requisits per a la seva entrada en vigor:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ingr\u00e9s del 6% en concepte d&#8217;honoraris<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Com assenyala el nostre administrador, Esteban Casanueva, hi ha dues opcions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>a) Signatura del contracte de renda garantida:<\/strong>\u00a0S&#8217;aplica la cobertura descrita.<\/li>\n\n\n\n<li><strong>b) Sense renda garantida:<\/strong>\u00a0El propietari assumeix el risc d&#8217;acceptar l&#8217;inquil\u00ed.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Aplicaci\u00f3 del sistema de &#8216;scoring&#8217;<\/h2>\n\n\n\n<p>L&#8217;<em>scoring<\/em>&nbsp;\u00e9s un percentatge que valora el risc d&#8217;impagament. Grup Housfy treballa amb la plataforma&nbsp;<strong>&#8220;<a href=\"https:\/\/elbueninquilino.es\/landing\">El Bon Inquil\u00ed<\/a>&#8221; (EBI)<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si el c\u00e0lcul d&#8217;EBI indica un\u00a0<strong>80% o menys<\/strong>, el perfil no es considera \u00f2ptim.<\/li>\n\n\n\n<li>Si el percentatge \u00e9s del\u00a0<strong>85% o m\u00e9s<\/strong>\u00a0(despr\u00e9s de creuar documentaci\u00f3 oficial d&#8217;ingressos amb fitxers de morositat), estem davant d&#8217;un perfil de solv\u00e8ncia acreditada.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Cl\u00e0usula de &#8220;cessi\u00f3 de drets processals&#8221;<\/h2>\n\n\n\n<p>Finalment, oferim incloure aquesta cl\u00e0usula al contracte. Amb ella, l&#8217;arrendador ens atorga poders per demandar l&#8217;arrendatari en cas d&#8217;impagament.
