Per fer-ho, com veurem m\u00e9s endavant,&nbsp;ser\u00e0 imprescindible&nbsp;convocar una Junta.&nbsp;<\/p>\n\n\n\n<p>Avui tamb\u00e9 podr\u00e0s copsar com portar la reuni\u00f3 de tots els propietaris.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&nbsp;<\/h2>\n\n\n\n<h2 class=\"wp-block-heading\">Els dos passos vers una Junta de Propietaris impecable<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">Professionalitzar la gesti\u00f3 de la finca&nbsp;<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><\/h3>\n\n\n\n<p>Quan es forma la Comunitat de Propietaris neix la Junta de Propietaris. Per fer\u00a0aquest \u00f2rgan\u00a0operatiu\u00a0cal designar-hi: President, Vicepresident i Secretari. \u00c9s llavors quan\u00a0contractar un dels nostres\u00a0<a href=\"https:\/\/www.fincasolivares.com\/servicios\/administracion-fincas-barcelona\/\" type=\"link\" id=\"https:\/\/www.fincasolivares.com\/servicios\/administracion-fincas-barcelona\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Administradors de Finques<\/strong><\/a>\u00a0dona:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>&nbsp;<strong>S<\/strong><strong>eguretat jur\u00eddica:&nbsp;<\/strong>Per tal que&nbsp;la vostra comunitat mai&nbsp;incompleixi cap disposici\u00f3 legal.<\/li>\n\n\n\n<li><strong>Assist\u00e8ncia a l\u2019hora de dirigir les Juntes:\u00a0<\/strong>A l&#8217;hora de <strong><a href=\"https:\/\/housfy.com\/blog\/comunidad-de-vecinos-comunidad-de-vecinos-guia\/?utm_source=blog&amp;utm_content=%2Fblog\" type=\"link\" id=\"https:\/\/housfy.com\/blog\/comunidad-de-vecinos-comunidad-de-vecinos-guia\/?utm_source=blog&amp;utm_content=%2Fblog\" target=\"_blank\" rel=\"noreferrer noopener\">resoldre dubtes i\u00a0apaivagar conflictes.<\/a>\u00a0<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u00c9s important destacar, per\u00f2, que&nbsp;<strong>ni l\u2019exercici individual de la Presid\u00e8ncia ni tampoc la iniciativa col\u00b7legiada de la Junta&nbsp;<\/strong>poden delegar-se.<\/p>\n\n\n\n<p>De cara a sup\u00f2sits com el que avui veurem, l\u2019incompliment acord de la Junta, \u00e9s imprescindible que la vostra comunitat tamb\u00e9\u00a0compti amb advocat.\u00a0<\/p>\n\n\n\n<p>Per contractar administrador i advocat cal majoria simple de vots i quotes de participaci\u00f3<sup>1<\/sup>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">Les cinc fases per convertir un acord de la Junta en impecable&nbsp;<\/h3>\n\n\n\n<p>En una convocat\u00f2ria ordin\u00e0ria o una extraordin\u00e0ria hi ha cinc fases que&nbsp;converteixen&nbsp;en impecable&nbsp;l\u2019acord adoptat:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Convocar la Junta&nbsp;adequadament.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Informant&nbsp;de la seva celebraci\u00f3&nbsp;per<strong>&nbsp;tots els mitjans possibles<\/strong>.<\/li>\n\n\n\n<li>Amb l\u2019antelaci\u00f3 que pertoca:&nbsp;<strong>Vuit dies en el cas de les ordin\u00e0ries i un m\u00ednim de tres en les extraordin\u00e0ries<\/strong>.<\/li>\n\n\n\n<li>Fent constar a la convocat\u00f2ria:&nbsp;<strong>Data, hora<\/strong>,&nbsp;<strong>lloc<\/strong>,&nbsp;<strong>ordre del dia<\/strong>,&nbsp;<strong>advertiment sobre el valor del vot dels absents i llistat dels propietaris deutors.&nbsp;<\/strong>Els arrendadors en aquesta situaci\u00f3, a menys que, quan comenci la Junta, consignin els pagaments endarrerits, no tenen dret a vot.<\/li>\n<\/ul>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Revisar,&nbsp;<em>ex ante,<\/em>&nbsp;la legalitat de l\u2019acord que vulgueu&nbsp;votar. Aquest mai ha de<strong>:<\/strong><\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Vulnerar la<strong>&nbsp;Llei.<\/strong><\/li>\n\n\n\n<li>Contradir els<strong>&nbsp;Estatuts de la Comunitat.<\/strong><\/li>\n\n\n\n<li>Violar el<strong>&nbsp;Reglament Intern<\/strong>.<\/li>\n<\/ul>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>Supervisar,&nbsp;<em>ex ante<\/em>, que l\u2019acord que vulgueu votar&nbsp;<strong>no sigui manifestament arbitrari<\/strong>: Ni pot estar concebut per perjudicar a un propietari, ni per beneficiar-ne d\u2019altres de forma indeguda.<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>Assolir el<strong>\u00a0qu\u00f2rum<\/strong>, a m\u00e9s dela<strong>\u00a0majoria dels vots i quotes\u00a0de participaci\u00f3\u00a0<\/strong>requerida en cada cas pel Codi Civil Catal\u00e0.<\/li>\n<\/ol>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li>Anotar, per part del&nbsp;<strong>Secretari<\/strong>, l\u2019aprovaci\u00f3 de l\u2019acord a&nbsp;<strong>l\u2019Acta de la Junta.&nbsp;<\/strong><\/li>\n<\/ol>\n\n\n\n<p>\u00c9s crucial validarels punts dos i tres. &nbsp;El seu incompliment legitima per impugnar l\u2019acord judicialment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Incompliment acord de la Junta com actuar d\u2019acord amb el Codi Civil Catal\u00e0?<\/h2>\n\n\n\n<p>Nom\u00e9s un cop exigida la perfecci\u00f3 legal a la Junta podem fixar-nos en propietaris individuals que vulneren el Dret.<\/p>\n\n\n\n<p>Ho fem responent, de forma m\u00e9s completa que a l\u2019inici del text, \u201cqu\u00e8 podem fer davant un incompliment acord de la junta?\u201d<\/p>\n\n\n\n<p>\u00c9s a l\u2019<strong>Article 553-30.4<\/strong>&nbsp;del Codi Civil Catal\u00e0 on el legislador estableix, sense cap vacil\u00b7laci\u00f3, que aquesta conducta t\u00e9 greus conseq\u00fc\u00e8ncies.<\/p>\n\n\n\n<p>Llegim-lo:<\/p>\n\n\n\n<p>&nbsp;\u201cEls propietaris que,&nbsp;<strong>sense causa justificada<\/strong>, s\u2019oposin a les actuacions o obres necess\u00e0ries i exigides per l\u2019autoritat competent o les demorin&nbsp;<strong>responen individualment&nbsp;<\/strong>de les sancions que s\u2019imposin en via administrativa\u201d.<\/p>\n\n\n\n<p>Tanmateix, de la literalitat de l\u2019extracte no es dedueix ni:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Com est\u00e0 legitimada&nbsp;la Comunitat&nbsp;per comen\u00e7ar&nbsp;aquesta \u201cvia administrativa\u201d contra el propietari incomplidor.<\/li>\n\n\n\n<li>Quina \u00e9s l\u2019autoritat competent per sancionar a aquesta persona f\u00edsica o jur\u00eddica.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>&nbsp;La nostra administradora Susana Jord\u00e1n ho aclareix:<\/p>\n\n\n\n<p>\u201cLa Comunitat ha de demandar judicialmental propietari infractor. \u00c9s cert que els jutges poden divergir, per\u00f2, nom\u00e9s una sent\u00e8ncia judicial tancar\u00e0 el conflicte\u201d.&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">Abans d\u2019acudir a la just\u00edcia cal convocar expressament una Junta<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><\/h3>\n\n\n\n<p>A l\u2019ordre del dia de la Junta de Propietaris hi ha de constar el punt: \u201cvotar i aprovar demanda judicial per incompliment acord de la Junta\u201d.&nbsp;Per aprovar l\u2019inici de la demanda, cal&nbsp;<strong>majoria simple de vots i quotes de participaci\u00f3<\/strong>. Un cop aquesta s\u2019hagi obtingut es podr\u00e0 obrir el cam\u00ed cap a una resoluci\u00f3.<\/p>\n\n\n\n<p>Podem denunciar l\u2019incompliment acord de la Junta a qualsevol jutjat?<\/p>\n\n\n\n<p>No. Cal, personar-se al&nbsp;<strong>jutjat de primera inst\u00e0ncia de la localitat on \u00e9s l\u2019edifici de la vostra comunitat<\/strong>.<\/p>\n\n\n\n<p>Finalment, quan es parla d\u2019un judici \u00e9s crucial analitzar qui en\u00a0pagar\u00e0 les costes processals.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">El cas espec\u00edfic d\u2019incomplir acords que impliquen pagaments a la comunitat<\/h3>\n\n\n\n<p>L&#8217;obligaci\u00f3 de pagar la teva quota\u00a0de participaci\u00f3 arrela a l\u2019article 553-4.1 del Codi Civil Catal\u00e0:<\/p>\n\n\n\n<p>\u201c<strong>Tots els propietaris s\u00f3n titulars mancomunats, tant dels cr\u00e8dits constitu\u00efts a favor de la comunitat com dels deutes&nbsp;<\/strong>contrets v\u00e0lidament (&#8230;)\u201d.&nbsp;<\/p>\n\n\n\n<p>Aclarit aix\u00f2, cal tenir present la documentaci\u00f3 que fa falta per reclamar el pagament d\u2019un deute.<\/p>\n\n\n\n<p>Ho indica l\u2019article 553-47.2:<\/p>\n\n\n\n<p>(\u2026) \u201cN\u2019hi ha prou amb un certificat (\u2026) em\u00e8s per qui faci les funcions de secretari de la comunitat amb el vistiplau del president. En aquest certificat hi han de constar<strong>&nbsp;l\u2019exist\u00e8ncia del deute i el seu import, la manifestaci\u00f3 que el deute \u00e9s exigible i que es correspon de manera exacta amb els comptes aprovats per la junta de propietaris que consten en el llibre d\u2019actes corresponent, i el requeriment de pagament fet al deutor<\/strong>.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&nbsp;<\/h2>\n\n\n\n<h2 class=\"wp-block-heading\">Article 553-30 del Codi Civil Catal\u00e0 \u201cVinculaci\u00f3 dels acords\u201d<\/h2>\n\n\n\n<p>Nom\u00e9s podem parlar d\u2019incompliment perqu\u00e8, un cop aprovats en Junta,<strong>&nbsp;els acords vinculen legalment<\/strong>. A continuaci\u00f3 analitzem com el Codi Civil Catal\u00e0 tracta aquest tema.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">Codi Civil Catal\u00e0 article 553-30 punts primer i tercer: La protecci\u00f3 de la comunitat<\/h3>\n\n\n\n<p>Article 533-30.1:<\/p>\n\n\n\n<p>\u201cEls acords adoptats per la Junta de Propietaris s\u00f3n obligatoris i&nbsp;<strong>vinculen tots els propietaris, fins i tot els dissidents<\/strong>&#8220;.<\/p>\n\n\n\n<p>Aquest primer punt garanteix a la Comunitat que&nbsp;<strong>mai cap propietari podr\u00e0 escollir, d\u2019entrada, no contribuir&nbsp;<\/strong>a les actuacions aprovades legalment<strong>.<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p>Article 553-30.3:<\/p>\n\n\n\n<p>Les despeses originades per la&nbsp;<strong>supressi\u00f3 de barreres arquitect\u00f2niques<\/strong>&nbsp;o la instal\u00b7laci\u00f3 d\u2019ascensors i les que calguin per a&nbsp;<strong>garantir l\u2019accessibilitat i l\u2019habitabilitat<\/strong>&nbsp;de l\u2019edifici s\u00f3n a c\u00e0rrec de tots els propietaris si deriven d\u2019un acord de la junta de propietaris (\u2026).<\/p>\n\n\n\n<p>Aquest tercer ep\u00edgraf recorda que hi ha dues despeses obligat\u00f2ries. Les que:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Garanteixen a les persones amb problemes de mobilitat accedir a casa seva.<\/li>\n\n\n\n<li>Financen la seguretat estructural de l\u2019edifici.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">Codi Civil Catal\u00e0 article 553-30.2: La excepci\u00f3 a favor dels propietaris dissidents<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><\/h3>\n\n\n\n<p>El legislador deixa clar que \u201cdissident\u201d no \u00e9s el mateix que \u201cincomplidor\u201d. El propietari dissident t\u00e9 una argumentaci\u00f3 objectiva, en canvi, l\u2019incomplidor est\u00e0 en fals (en paraules l\u2019article 553-30.4&nbsp;\u201csense causa justificada\u201d) .<\/p>\n\n\n\n<p>A l\u2019article 553-30.2 concreta els dos casos per admetre que la dissid\u00e8ncia eximeixi d\u2019un pagament.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">&nbsp;Article 553-30.2:<\/h3>\n\n\n\n<p>&#8220;No obstant el que estableix l\u2019apartat 1, els propietaris dissidents no estan obligats a satisfer les despeses originades per les noves instal\u00b7lacions o nous serveis comuns que&nbsp;<strong>no siguin exigibles d\u2019acord amb la llei<\/strong>&nbsp;si el valor total de la despesa acordada \u00e9s&nbsp;<strong>superior a la quarta part&nbsp;<\/strong>del pressupost anual vigent de la comunitat.<\/p>\n\n\n\n<p>Esperem haver-vos orientat. &nbsp;<\/p>\n\n\n\n<p><sup>1&nbsp;: \u00c9s a l \u2018article 553-25 ep\u00edgraf f) el Codi Civil Catal\u00e0 estableix que: \u201cS\u2019aproven per majoria simple de propietaris i quotes els acords que no tinguin fixada una majoria diferent per a adoptar-los\u201d.<\/sup><\/p>\n\n\n\n<p><sup>De l\u2019ep\u00edgraf a) fins a la e) el legislador enumera quines decisions requereixen majoria simple de vots i quotes. S\u00f3n aquestes:<\/sup><\/p>\n\n\n\n<p><br><sup>\u00bba) L\u2019execuci\u00f3 d\u2019obres o l\u2019establiment de serveis que tenen la finalitat de suprimir barreres arquitect\u00f2niques o la instal\u00b7laci\u00f3 d\u2019ascensors, encara que l\u2019acord comporti la modificaci\u00f3 del t\u00edtol de constituci\u00f3 i dels estatuts o encara que les obres o els serveis afectin l\u2019estructura o la configuraci\u00f3 exterior.<br><br>\u00bbb) Les innovacions exigibles per a l\u2019habitabilitat, l\u2019accessibilitat o la seguretat de l\u2019immoble, segons llur naturalesa i caracter\u00edstiques, encara que l\u2019acord comporti la modificaci\u00f3 del t\u00edtol de constituci\u00f3 i dels estatuts o afectin l\u2019estructura o la configuraci\u00f3 exterior.<br><br>\u00bbc) L\u2019execuci\u00f3 de les obres necess\u00e0ries per a instal\u00b7lar infraestructures comunes o equips amb la finalitat de millorar l\u2019efici\u00e8ncia energ\u00e8tica o h\u00eddrica dels immobles i la mobilitat dels usuaris, per a connectar serveis de telecomunicacions de banda ampla o per a individualitzar el mesurament dels consums d\u2019aigua, gas o electricitat, o per a la instal\u00b7laci\u00f3 general de punts de rec\u00e0rrega per a vehicles el\u00e8ctrics, encara que l\u2019acord comporti la modificaci\u00f3 del t\u00edtol de constituci\u00f3 i dels estatuts.<br><br>\u00bbd) Les normes del reglament de r\u00e8gim interior.<br><br>\u00bbe) L\u2019acord de sotmetre a mediaci\u00f3 qualsevol q\u00fcesti\u00f3 pr\u00f2pia del r\u00e8gim de la propietat horitzontal.<\/sup><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Quan es dona un incompliment acord de la Junta, cal&nbsp;demandar judicialment al propietari infractor.
