Ara b\u00e9, aix\u00f2, nom\u00e9s \u00e9s possiblequan els<strong>&nbsp;Estatuts ho autoritzin<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Lloguer tur\u00edstic Catalunya: An\u00e0lisi dels ep\u00edgrafs a i b de l\u2019article 553-11 del Codi Civil Catal\u00e0<\/h2>\n\n\n\n<p>L\u2019article 553-11.1 detalla&nbsp;<strong>totes les limitacions legals als Estatuts<\/strong>&nbsp;de la comunitat. &nbsp;<\/p>\n\n\n\n<p>Qu\u00e8 pot regular la comunitat de propietaris d\u2019acord amb els ep\u00edgrafs a i b?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Lletra a: \u201dLa destinaci\u00f3, l\u2019\u00fas i&nbsp;<strong>l\u2019aprofitament dels elements privatius<\/strong>&nbsp;i dels elements comuns&#8221;.<\/li>\n\n\n\n<li>Lletra b: \u201cLes&nbsp;<strong>limitacions d\u2019\u00fas&nbsp;<\/strong>i altres c\u00e0rregues&nbsp;<strong>dels elements privatius<\/strong>\u201d.<\/li>\n<\/ul>\n\n\n\n<p>L\u2019establiment d\u2019arrendaments tur\u00edstics a l\u2019edifici ser\u00e0 il\u00b7legal quan:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Es redacti l\u2019escrit d\u2019acord amb els ep\u00edgrafs a) i b): Aquest, de manera<strong>\u00a0jur\u00eddicament impecable i clara<\/strong>\u00a0ha de vetar\u00a0l\u2019establiment d\u2019arrendaments tur\u00edstics\u00a0o b\u00e9 d&#8217;empreses\u00a0dins la comunitat.<\/li>\n\n\n\n<li>S\u2019aprovi en Junta amb:<strong>&nbsp;4\/5 Parts (80%) de vots afirmatius que siguin iguals a aquesta mateixa proporci\u00f3 de quotes de participaci\u00f3.<\/strong><\/li>\n\n\n\n<li>El veto lloguer tur\u00edstic Catalunya s\u2019inclogui en el\u00a0text dels:\u00a0<strong><a href=\"https:\/\/housfy.com\/blog\/estatutos-comunidad-de-vecinos\/?utm_source=blog&amp;utm_content=%2Fblog\" type=\"link\" id=\"https:\/\/housfy.com\/blog\/estatutos-comunidad-de-vecinos\/?utm_source=blog&amp;utm_content=%2Fblog\" target=\"_blank\" rel=\"noreferrer noopener\">Estatuts vigents a la comunitat.<\/a><\/strong><\/li>\n<\/ol>\n\n\n\n<p><em>A contrario sensu,<\/em>&nbsp;<strong>establir pisos tur\u00edstics ser\u00e0 totalment legal<\/strong>&nbsp;quan els propietaris no hagin fet constar<strong>&nbsp;cap limitaci\u00f3<\/strong>. Aix\u00f2 ser\u00e0 aix\u00ed fins que&nbsp;<strong>canvi\u00ef la redacci\u00f3 dels Estatuts<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">La irretroactivitat de la variaci\u00f3 dels Estatuts<\/h3>\n\n\n\n<p>Una prohibici\u00f3 nascuda d\u2019una variaci\u00f3 als Estatuts&nbsp;<strong>mai podr\u00e0 aplicar-se retroactivament<sup>1<\/sup><\/strong>. Aix\u00f2 significa que quan ala comunitat hi hagi immobles tur\u00edstics llogats&nbsp;<strong>abans d\u2019alterar els Estatuts<\/strong><sup>2<\/sup>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Aquesta no tindr\u00e0 dret a exigir la&nbsp;<strong>rescissi\u00f3 d\u2019aquests contractes<\/strong>&nbsp;d\u2019arrendament.&nbsp;&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">El Codi Civil Catal\u00e0: Legislaci\u00f3 exclusiva pel dret immobiliari a Catalunya<\/h2>\n\n\n\n<p>\u201cLegislaci\u00f3 exclusiva\u201d vol dir que a&nbsp;<strong>Catalunya no s\u2019apliquen normes alienes de Dret Immobiliari<\/strong>. Aix\u00f2 t\u00e9 una conseq\u00fc\u00e8ncia pr\u00e0ctica fonamental:<\/p>\n\n\n\n<p>\u00c9s indiferent que, el Tribunal Suprem nom\u00e9s exigeixi 3\/5 parts de vots i quotes la majoria per vetar els allotjaments tur\u00edstics<sup>3<\/sup>. La ra\u00f3 \u00e9s que esbasa en l\u2019article 17.12 de la Llei Propietat Horitzontal, que no regeix a Catalunya<sup>4<\/sup>.<\/p>\n\n\n\n<p>Per prohibir el lloguer tur\u00edstic a Catalunya la majoria dels vots i les quotes de participaci\u00f3 necess\u00e0ria<strong>&nbsp;continua sent 4\/5 parts (80%)<\/strong>. Aquesta proporci\u00f3 s\u2019estableix a l\u2019article del Codi Civil Catal\u00e0 dedicat a l\u2019\u201cAdopci\u00f3 d\u2019acords per unanimitat i per majories qualificades\u201d.&nbsp;Ens referim al&nbsp;<strong>553-26-2 ep\u00edgraf a)<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">An\u00e0lisi de l\u2019article 553-26.2 ep\u00edgraf a) del Codi Civil Catal\u00e0<\/h2>\n\n\n\n<p>A continuaci\u00f3 pots llegir-ne els apartats citats:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Encap\u00e7alament del punt segon de l\u2019article vint-i-sis:<\/li>\n<\/ol>\n\n\n\n<p>&nbsp;\u201cCal el vot favorable de les quatre cinquenes parts dels propietaris amb dret a vot, que han de representar alhora les quatre cinquenes parts de les quotes de participaci\u00f3(\u2026).<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Ep\u00edgraf a):<\/li>\n<\/ol>\n\n\n\n<p>\u201cModificar el T\u00edtol de Constituci\u00f3 i&nbsp;<strong>els Estatuts<\/strong>, tret que existeixi una disposici\u00f3 legal en sentit contrari\u201d.<\/p>\n\n\n\n<p>La lectura de l\u2019article evidencia que l\u2019important pel legislador \u00e9s el compliment de la proporci\u00f3 legal d\u2019aprovaci\u00f3 per canviar els Estatuts, no quan es canvien.<\/p>\n\n\n\n<p>Acabem amb una pregunta que es planteja quan existeixen lloguers tur\u00edstics a la comunitat: He de declarar l\u2019arrendament tur\u00edstic?
