{"id":349207,"date":"2025-11-17T15:15:38","date_gmt":"2025-11-17T14:15:38","guid":{"rendered":"https:\/\/www.fincasolivares.com\/?p=349207"},"modified":"2025-11-17T15:15:40","modified_gmt":"2025-11-17T14:15:40","slug":"3-suposits-legals-en-que-larrendador-pot-rescindir-el-contracte","status":"publish","type":"post","link":"https:\/\/www.fincasolivares.com\/ca\/3-suposits-legals-en-que-larrendador-pot-rescindir-el-contracte\/","title":{"rendered":"3 sup\u00f2sits legals en qu\u00e8 l&#8217;arrendador pot rescindir el contracte"},"content":{"rendered":"\n<p>Els contractes d&#8217;arrendament d&#8217;habitatge habitual, d&#8217;acord amb la legislaci\u00f3 vigent, estableixen per\u00edodes de pr\u00f2rroga obligat\u00f2ria que es poden estendre fins a 5 anys si l&#8217;arrendador \u00e9s una persona f\u00edsica, o fins a 7 anys si es tracta d&#8217;una persona jur\u00eddica. No obstant aix\u00f2, existeixen <strong>casos taxats per llei<\/strong> que confereixen al propietari el <strong>dret de rescindir el contracte de lloguer abans de la finalitzaci\u00f3 d&#8217;aquest per\u00edode.<\/strong> A continuaci\u00f3, es detallen aquests sup\u00f2sits.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Causals legals per les quals el propietari pot extingir anticipadament l&#8217;arrendament<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Necessitat de recuperar la propietat per a \u00fas propi o familiar directe<\/h3>\n\n\n\n<p>L&#8217;arrendador t\u00e9 la facultat de <strong>sol\u00b7licitar la devoluci\u00f3 de l&#8217;habitatge<\/strong> sempre que acrediti la seva <strong>necessitat d&#8217;ocupar-la com a resid\u00e8ncia permanent<\/strong>, ja sigui per a ell mateix o per als seus familiars en primer grau de consanguinitat, adopci\u00f3, o per al seu c\u00f2njuge en situacions de separaci\u00f3, divorci o nul\u00b7litat matrimonial dictades per sent\u00e8ncia ferma.<\/p>\n\n\n\n<p>Per exercir aquest dret, \u00e9s imperatiu complir amb una s\u00e8rie de requisits:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El propietari ha d&#8217;ostentar la condici\u00f3 de <strong>persona f\u00edsica.<\/strong><\/li>\n\n\n\n<li>Ha d&#8217;haver transcorregut el <strong>primer any de vig\u00e8ncia de l&#8217;acord contractual.<\/strong><\/li>\n\n\n\n<li>La <strong>intenci\u00f3 de recuperar l&#8217;immoble<\/strong> ha d&#8217;haver estat expressament <strong>inclosa com a cl\u00e0usula en el document d&#8217;arrendament.<\/strong><\/li>\n\n\n\n<li>Segons l&#8217;estipulat a l&#8217;article 9.3 de la Llei d&#8217;Arrendaments Urbans (LAU), el propietari ha de <strong>notificar aquesta decisi\u00f3 a l&#8217;inquil\u00ed<\/strong>, especificant la causa del recobrament, amb una antelaci\u00f3 m\u00ednima de dos mesos.<\/li>\n<\/ul>\n\n\n\n<p>En cas que l&#8217;arrendador o el familiar designat no ocupin la propietat dins dels <strong>tres mesos posteriors a l&#8217;extinci\u00f3 contractual<\/strong>, l&#8217;arrendatari disposar\u00e0 d&#8217;un <strong>termini de 30 dies<\/strong> per triar entre la <strong>reocupaci\u00f3 de l&#8217;immoble<\/strong> (amb la corresponent indemnitzaci\u00f3 per despeses de desallotjament) o percebre una <strong>indemnitzaci\u00f3<\/strong> equivalent a una mensualitat per cada any restant fins a completar els cinc anys de contracte.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Incompliment del deure de pagament de les rendes<\/h3>\n\n\n\n<p>La <strong>manca d&#8217;abonament del lloguer<\/strong> o <strong>qualsevol retard recurrent<\/strong> en el pagament de les mensualitats constitueix una causa justificada i suficient per instar la resoluci\u00f3 del contracte i, en conseq\u00fc\u00e8ncia, el desallotjament de l&#8217;immoble.<\/p>\n\n\n\n<p>No obstant aix\u00f2, com a gestors, sempre recomanem abordar la situaci\u00f3 inicialment des de la <strong>via amistosa<\/strong>. \u00c9s aconsellable contactar amb l&#8217;arrendatari, comprendre la ra\u00f3 del retard i requerir el pagament per mitjans que deixin const\u00e0ncia, oferint un <strong>termini de cortesia<\/strong>.<\/p>\n\n\n\n<p>En cas que l&#8217;inquil\u00ed persisteixi en l&#8217;omissi\u00f3 del pagament, el propietari est\u00e0 plenament facultat per <strong>iniciar el procediment judicial de desnonament <\/strong>per recuperar la seva propietat.<\/p>\n\n\n\n<p>Per a una major seguretat i minimitzar els riscos financers, s&#8217;aconsella encaridament la <a href=\"https:\/\/housfy.com\/alquileres\/seguro-impago-alquiler\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>contractaci\u00f3 d&#8217;una asseguran\u00e7a d&#8217;impagament de lloguers<\/strong><\/a> a trav\u00e9s de <strong>Housfy<\/strong>, el qual et protegir\u00e0 la inversi\u00f3 de l&#8217;arrendador.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trencament d&#8217;altres obligacions contractuals per l&#8217;inquil\u00ed<\/h3>\n\n\n\n<p>El pagament de la renda mensual no \u00e9s l&#8217;\u00fanica obligaci\u00f3 que emana del contracte de lloguer. <strong>L&#8217;incompliment de qualsevol altra estipulaci\u00f3<\/strong> continguda en el document pot ser esgrimit pel propietari com a <strong>motiu per a la rescissi\u00f3 contractual anticipada.<\/strong><\/p>\n\n\n\n<p>Es consideren exemples d&#8217;incompliments contractuals greus els seg\u00fcents: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>L&#8217;impagament de la fian\u00e7a legal<\/strong><\/li>\n\n\n\n<li><strong>El sotsarrendament o la cessi\u00f3 de l&#8217;habitatge (o parts d&#8217;ella) sense el consentiment expl\u00edcit de l&#8217;arrendador<\/strong><\/li>\n\n\n\n<li><strong>Causar danys materials a la propietat<\/strong><\/li>\n\n\n\n<li><strong>La realitzaci\u00f3 d&#8217;activitats il\u00b7l\u00edcites, molestes, perilloses o nocives<\/strong><\/li>\n\n\n\n<li><strong>Execuci\u00f3 d&#8217;obres sense l&#8217;autoritzaci\u00f3 pertinent<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Asseguri la seva inversi\u00f3 i simplifiqui la gesti\u00f3 del lloguer<\/h2>\n\n\n\n<p>T\u00e9 previst arrendar el seu pis i li preocupa la possibilitat d&#8217;un incompliment contractual que demori la recuperaci\u00f3 de la seva propietat?<\/p>\n\n\n\n<p>Existeixen serveis de gesti\u00f3 integral del lloguer que
